By accessing or using ProoflyApp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
ProoflyApp provides a platform for businesses to collect, manage, and display customer testimonials and reviews. The Service includes tools for creating testimonial collection pages, managing submissions, and embedding review widgets on external websites.
3. Account Registration
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep your account information up to date.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Submit or display false, misleading, or fabricated testimonials
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service
- Use the Service to send spam or unsolicited communications
5. User Content
You retain ownership of any content you submit to the Service, including testimonials, business information, and media. By submitting content, you grant ProoflyApp a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of providing the Service.
6. Subscription and Payments
Some features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. Refunds are not provided for partial billing periods.
7. Intellectual Property
The Service, including its design, features, and content (excluding user-submitted content), is the property of ProoflyApp and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law, ProoflyApp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
9. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated terms on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the modified terms.
